Terms of Use

Laurie Fagundes (the “Owner”) provides the information and services on its websites cppstudyguide.com and payrollfocus.com (the “Site” or “Sites”) under the following terms and conditions. By accessing and/or using the Site you indicate your acceptance of these terms and conditions. The Owner reserves the right to change or modify any of the terms and conditions contained herein (including, without limitation, the Privacy Policy and Refund Policy) at any time and without notice in her sole discretion.

Definitions.”Book” refers to all editions of The Practical CPP Study Guide. “Tools” refer to all editions of The Practical CPP Study Tools. “Products” refer to all editions of both the Book and the Tools. “Buyer” refers to purchaser of Products. “User” refers to anyone accessing this website.

General Conditions. The Owner reserves the right to refuse service to anyone for any reason at any time and to refuse or cancel any order you place. Violation of the terms and conditions may result in the cancellation of access to the Tools, at the sole discretion of the Owner. No refunds will be given if your access is revoked for violating any of these terms and conditions. Prices for the Products are subject to change without notice. The Owner reserves the right at any time to modify or discontinue the Products (or any part or content thereof) without notice at any time. The Owner or her heirs shall not be liable to you or to any third-party for any modification, price change, suspension, cancellation or discontinuance of the Products.

Delivery of Products. Links to the Products are automatically emailed to the email address provided by the Buyer during the checkout process. Owner is not responsible if Buyer provides an invalid or incorrect email address. Owner’s sending of the automated emails constitute Buyer’s constructive receipt of Products. The refund window begins on the original purchase date. If Buyer has not received the emails with the links to access the Products within two hours after purchase it is Buyer’s responsibility to contact Owner immediately. If Buyer contacts owner beyond 14 calendar days after purchase date stating Buyer did not receive the links to the Product, Owner may, at Owner’s option, resend the links, however the return window is closed and Buyer is not entitled to a refund. Each Product edition is sold separately. One-year access to the online study tools ends one-year after the original purchase date irrespective of the date the Buyer first accesses the study tools. Under no circumstances does the purchase of one edition entitle the Buyer access to a different edition.

Study Tools Editions. Each edition of study tools is retired on Sept 30th following the end of the target exam window. Buyers are entitled to access the study tools as often as they like through the earlier of their one-year purchase anniversary or the retirement of the study tools edition. Each annual edition coincides with a PayrollOrg exam period. Each edition is sold separately.

Dormant Accounts. Accounts are deemed dormant if a User has not logged into their account for a period of 5 months. Dormant accounts may be deleted at the discretion of the Owner. If the Buyer of the dormant account has time remaining on their purchase, Buyer may create a new account using their enrollment key and use the new account until the original end date of their access. If Buyer no longer has their enrollment key, Buyer may contact Owner for a key.

Blocked Buyers. Buyers will be blocked from making purchases for the following reasons: Buyer filing a dispute or chargeback, violating any provision of the Terms of Use, or for requesting a refund. Blocked buyers are responsible for fees incurred by the Owner due to the blocked buyer’s repeated attempts to make a purchase. At the sole discretion of the Owner, a blocked Buyer’s refund may be reduced by any fees the Owner incurs to process the payment and/or refund.

Email Marketing. By making a purchase you are opting-in to receive email campaigns. Email campaigns will include a link to unsubscribe from future mailings.

Laws and Regulations. Access to and use of this Site are subject to all applicable international, federal, state and local laws and regulations. User agrees not to use the Site in any way that violates such laws or regulations.

Copyright and Trademarks. The information, Book and Tools available on or through this Site is the property of the Owner, and is protected by copyright, trademark, and other intellectual property laws. Users may not modify, copy, distribute, transmit, display, publish, sell, license, create derivative works or otherwise use any information available on or through this Site for commercial or public purposes. Users may not use the trademarks or logos on this Site for any purpose including, but not limited to use as “hot links” or meta tags in other pages or sites on the World Wide Web without the written permission of the Owner or such third party that may own the trademark. Users who have received a refund who retain, electronically or printed, any Products are violating Owner’s copyright.

Restrictions on Use. Purchase of the Products on this site entitles Buyer to individual personal use. Buyer is not allowed to give or sell the Book to anyone else nor is Buyer permitted to share or sell their Tools login credentials. If Buyer leads a study group and uses Products as part of their course, each member of the group must purchase their own copy. No part of Products may be reproduced, distributed, or transferred in any form or by any means, graphic, electronic, or mechanical, including photocopying, recording, taping, or by any information storage retrieval system, without the written permission of the author. Buyer is expressly forbidden from saving a copy of this book on a company’s network/Intranet or in a location accessible by others via the Internet.

Tampering. User agrees not to modify, move, add to, delete or otherwise tamper with the information contained in the Site. User also agrees not to decompile, reverse engineer, disassemble or unlawfully use or reproduce any of the software, copyrighted or trademarked material, trade secrets, or other proprietary information contained in the Site.

Links to Third Party Sites. This Site may contain links that will let you access other Websites. The links are only provided as a convenience, and the Owner does not endorse any of these sites. The Owner assumes no responsibility or liability for any material that may be accessed on other Websites reached through this Site, nor does the Owner make any representation regarding the quality of any product or service contained at any such site.

Links from Third Party Sites. The Owner prohibits unauthorized links to the Site and the framing of any information contained on the site or any portion of the Site. The Owner reserves the right to disable any unauthorized links or frames. The Owner has no responsibility or liability for any material on other Websites that may contain links to this Site.

No Warranties. Information and documents provided on this Site are provided “as is” without warranty of any kind, either express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, and non-infringement. The Owner uses reasonable efforts to include accurate and up-to-date information on this Site; the Owner does not, however, make any warranties or representations as to its accuracy or completeness. The Owner periodically adds, changes, improves, or updates the information documents and Products on this Site without notice. The Owner assumes no liability or responsibility for any errors or omissions in the content of this Site. Your use of this Site is at your own risk.

No Endorsement. The articles, tools, links, and other resources provided herein are solely for informational purposes, and do not constitute an endorsement by the Owner of any particular product or service.

Limitation of Liability. Under no circumstances shall the Owner be liable for any damages suffered by you, including any incidental, special or consequential damages (including, without limitation, any lost profits or damages for business interruption, loss of information, programs or other data) that result from access to, use of, or inability to access or use the sites or disruption of services including without limitation, DDoS attacks, software viruses, trojan horses, worms, time bombs, third-party server failures between Buyer’s and Owner’s ISPs, or any other technology, or Buyer’s failure to properly activate their Tools account, or Buyer’s inability to successfully download a PDF, or Buyer’s decision to not download the Book, or due to any breach of security associated with the transmission of information through the Internet, even if the Owner was previously advised of the possibility of such damages.

Privacy. Protecting the privacy of the users of the Site is important to the Owner. The Owner’s Privacy Statement describes how she uses and protects information you provide.

Security. The security of information transmitted through the Internet can never be guaranteed. The Owner is not responsible for any interception or interruption of any communications through the Internet or for changes to or losses of data. User is responsible for maintaining the security of any password, user ID, or other form of authentication involved in obtaining access to password protected or secure areas of the Site. In order to protect you and your data, the Owner may suspend your use of the Site without notice, pending an investigation, if any breach of security is suspected.

Access to Password Protected/Secure Areas. Access to and use of password protected and/or secure areas of the Sites is restricted to authorized Buyers only. Unauthorized access to such areas is prohibited and may lead to criminal prosecution. As part of the registration process, you will select a username and a password. You understand that you may not (i) select or use a name of another person with the intent to impersonate that person; (ii) use the rights of any person without authorization; or (iii) use a name that Owner, in her sole discretion, deem inappropriate. You are responsible for all usage or activity on your account, and you must keep your account password secure. Distribution of your password to others for access to the Site is expressly prohibited. You must immediately notify the Owner of any known or suspected unauthorized use(s) of your account, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of your username and/or password. Your purchase entitles you to one (1) year access to the specific edition of The Practical CPP Study Tools that you purchase.

Jurisdiction/Governing Law. These terms and conditions shall be governed and construed in accordance with the laws of the State of Idaho, USA, and applicable federal laws without regard to conflicts of law principles. User agrees that any and all proceedings relating to this site and the subject matter contained herein shall be maintained in the courts of the state of Idaho or the federal district courts sitting in Idaho, which courts shall have exclusive jurisdiction for such purpose.
